You must also notify us three months prior to your annual fee due date to confirm whether your casino is operational so that the correct annual fee is charged. Industry’s perspective was mixed, with some responses stating that the limits for cashless payments should mirror the current ones to minimise the risk of delay to implementing the relevant legislation. There were a range of responses to the questions relating to maximum deposit and committed payment limits. In relation to taking a cautious approach, we think that a £100 limit is appropriate considering that our aim is to try and replicate the process by which someone uses cash to play on a machine. This will act as a safeguard in case someone tries to put more than £100 onto the machine. It will also help mitigate against the risk of someone putting a significant sum of money onto a machine in one go.

We propose therefore that these machines are allowed to stay in unrestricted areas in licensed and unlicensed FECs, and other premises including but not limited to pubs and travelling fairs. If we required ‘cash-out’ slot-style Category D machines to be moved to age-restricted areas in licensed FECs, it is likely that operators would no longer site these machines. Unlicensed FECs are entitled to make only Category D machines available, once they have successfully applied for a permit from the licensing authority (local authority in England and Wales, licensing board in Scotland). As set out in the white paper, we believe that a more precautionary approach is justified for slot-style games which mirror the mechanics of adult-only gaming machines, particularly those which pay out cash. Currently, Category D machines have no age restrictions nor area restrictions in licensed/permitted premises.

While it is acknowledged that the risk of gambling harm may increase somewhat following a transition to 50/50, the stipulation outlined in Option 2 would ensure that operators offer a balance of higher and lower stake gaming machines. These changes would only come into effect if 1968 Act casinos elect to make more than 20 gaming machines (including at least one Category B machine) available to the customer.

We received a small number of responses from local authorities. Under Option 2(a), the Bingo Association has advised that 2 substantial multi-site bingo club operators and several single site operators would be disadvantaged by comparison to the current regime. However, while Option 1 was the most common secondary option for many of these respondents in the original consultation, the majority of respondents to the supplementary consultation were supportive of Option 2(b) above Option 1. Another operator stated that both options could, over time, potentially lead to a 20% to 25% increase in Category B cabinets and would likely lead to the reduction of tablets and in-fills to at most a nominal level. The reason provided for this preference is that Options 2(a) and 2(b) would provide greater commercial flexibility over the long-term – with Option 2(b) providing the greater flexibility of the 2 options.

We will also amend the current inconsistency in the regulations which requires Small 2005 Act casinos to have a table gaming area of at least 500sqm (identical to their minimum overall gambling area) by reducing this requirement to 250sqm.

If this proportion was representative across all casinos, then total casino sector GGY could increase by approximately £1.3 million. For example, 88% of casino customers also bet online on sports at least once a month. However, at this stage we do not know precisely what these costs will be, as we do not have any evidence on how casinos will respond to this. The policy could also encourage casinos to invest in broadcasting sport, both in broadcast rights and venue enhancement, which will have additional costs.

Casinos in the UK are generally operated under historic licences that were rolled forward under the “new” Gambling Act 2005. Gambling operators are subject to the advertising regulations of the UK Advertising Standards Authority and the industry of the British “Industry Group for Responsible Gambling”. The LCCP imposes extensive obligations upon licensees in, amongst others, the fields of social responsibility, anti-money laundering and the prevention of terrorist financing, consumer fairness and transparency, responsible advertising and obligations to comply with various technical standards that apply in respect of both non-remote and remote forms of gambling.

The regulator has indicated that it may be less inclined to “settle” regulatory enforcement actions, particularly where operators have been made the subject of prior regulatory enforcement action, leaning towards the imposition of sanctions and penalties or, in more serious cases, suspensions and revocations of licences.
